1. Acceptance of Terms

By accessing or using Ukta ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Ukta is a multi-tenant feedback collection platform that enables businesses to:

  • Collect customer feedback through kiosk devices and web surveys
  • Create and manage surveys with customizable themes
  • Analyze feedback data and generate insights
  • Manage multiple stores and team members
  • Receive real-time notifications and alerts

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

4. Subscription Plans and Payments

4.1 Plans

Ukta offers various subscription plans (Silver, Gold, Diamond) with different features and limitations. Plan details, pricing, and feature availability are described on our pricing page.

4.2 Free Trial

New users may be eligible for a free trial period. During the trial:

  • Access is limited to specific features and resources
  • Only one trial per email address is allowed
  • Trial workspaces expire automatically after the trial period
  • Data from expired trials is deleted after 30 days if not converted to a paid plan

4.3 Billing

For paid subscriptions:

  • You agree to pay all fees associated with your selected plan
  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable unless otherwise stated
  • We may change pricing with prior notice to you

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Collect user information without consent
  • Use the Service for spam or unsolicited communications
  • Reverse engineer or attempt to extract source code

6. User Content

6.1 Your Content

You retain ownership of any content you submit to the Service, including survey questions, themes, and organization data. By submitting content, you grant Ukta a license to use, store, and display such content as necessary to provide the Service.

6.2 Feedback Data

Feedback collected through your surveys belongs to you. We process this data on your behalf and in accordance with our Privacy Policy.

7. Intellectual Property

The Service and its original content (excluding user content), features, and functionality are owned by Ukta and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of the Service.

8. Third-Party Services

The Service may contain links to or integrate with third-party websites or services. We are not responsible for the content, policies, or practices of third-party services. Your use of such services is at your own risk.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. UKTA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UKTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Ukta and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination:

  • Your right to use the Service will immediately cease
  • You may request export of your data within 30 days
  • We may delete your data after the retention period

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting a notice on the Service or sending you an email. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
